South Dakota is one of the few states in the country not having any medical marijuana program. The production, sale and possession of any form of medicinal marijuana products are illegal in South Dakota.

The cultivation, sale, and possession of cannabis for recreational purposes are illegal in South Dakota.

South Dakota is not very tolerant when it comes to cannabis possession and any amount is going to get you in trouble.

Getting caught with up to 2 oz (56 grams) is treated as a misdemeanor and will land you in jail for up to 1 year and get you a fine of up to $2,000.

Getting caught with between 2-8 oz is treated as a felony and can land you in jail for 1 year and a fine of up to $4,000.

Getting caught with more than 8 oz (1/2 lb) will increase the penalties, starting from 5 years in jail and a fine starting from 10,000.

We are not aware of any possible law changes in the (near) future in South Dakota regarding medical and/or recreational cannabis.
