MEDICAL MARIJUANA IN NEW YORK

Medical marijuana products are legal for patients with a prescription from a licensed physician in New York since 2014. The medical marijuana program allows marijuana derived products, but plant materials are illegal and the law doesn't allow patients to smoke their medicine.

The qualifying conditions to become a medical marijuana patient in New York include:

  • Cancer
  • Chronic pain
  • Epilepsy
  • HIV/AIDS
  • Huntington's Disease
  • Inflammatory bowel disease
  • Lou Gehrig’s disease (ALS)
  • Multiple Sclerosis
  • Neuropathies
  • Parkinson's Disease
  • Spinal cord damage

RECREATIONAL MARIJUANA IN NEW YORK

The cultivation, sale, and possession of cannabis for recreational purposes are illegal in the state of New York.

If you get caught with less than 25 grams and it's your first offence, you are going to get off with just a fine of up to $100. Getting caught a second time for the same amount will get you a fine of up to $200. A third or any subsequent offense can actually get you send to jail for up to 15 days and get you a fine of up to $250.

If you get caught smoking weed in public view, it might get you send to jail for up to 90 days and get you a fine of up to $250.

Getting caught with between 25 grams and 2 oz (56 grams) is treated as a misdemeanor and can land you in jail for 3 months and get you a fine of up to $500. 2-8 oz is still a misdemeanor, but good for a year in jail and a fine of up to $1,000.

Getting caught with more than 8 oz is seen as a felony with jail sentences going up, starting from 4 years in jail.
